Celine Zara Design Terms & Conditions
Celine Zara Design is an independent, specialist designer and creator of bespoke garments and accessories. All purchases of goods and services from Us are subject to the terms and conditions set out below.
In these Terms and Conditions (Terms) the following words and phrases shall have the following meanings:
“You, your” means the person, firm or company who purchases Goods from Us;
“We, Us, Our” means Celine Zara Design;
“Contract” means the contract between Us and You which shall be deemed to incorporate these Terms;
“Goods” means any goods agreed in the Contract to be supplied by Us to the Buyer; “Place of Delivery” means the place to which the Goods are to be delivered;
“Carriage” means postage, packing and delivery.
Price and Payment
(i) The price for the Goods shall, unless agreed otherwise, be the price identified by Us to You and set out after the initial meeting and then clarified in writing. The price for the Goods shall be displayed exclusive of all and any costs of Carriage, including any insurance associated therewith.
(ii) Payment for accessories shall be made in full and upon the order for the Goods being placed.
(iii) With regard to bespoke garments, a deposit of 50% of the order value shall be due when You select the final design. Work will not commence until You have approved the design proposal and payment of the deposit has cleared into Our account. The remaining balance is payable at the final fitting.
(iv) It is understood that the initial deposit of 50% is wholly non-refundable.
(v) Payment for bespoke accessories can be made via Our website using credit or debit card.
(vi) Payment for bespoke garments can be made by cash, credit card, debit card or bank transfer. Payment shall not be deemed to have occurred until We have received cleared funds.
Weight Gain/Loss - (bespoke garments only)
Celine Zara Design manufactures each garment according to measurements taken during the initial meeting. Celine Zara Design shall not be held liable for any size variations due to weight gain or loss. Any changes required to the garment due to weight gain/loss will incur additional fees where necessary and it cannot be guaranteed that it will be possible to alter the garment to Your new size.
Cancellation Policy for Bespoke Accessories
(i) The customer must check the order form and confirm all the details are correct at the time of purchase.
(ii) It is understood that an order, once finalised and confirmed, cannot be cancelled except at the discretion of Celine Zara Design.
(iii) Any changes to an order must be made within 24 hours of the order confirmation. Making a change within the 24 hours of placing the order does not guarantee that a change can be made. Celine Zara Design will, where possible, endeavour to make the desired changes, but this may incur additional cost which must be paid when the order is revised.
(iv) Celine Zara Design cannot accept returns on the basis of a change of heart on the part of a customer.
(v) Nor can Celine Zara Design accept returns where the customer requests a change to an existing order and Celine Zara Design cannot fulfil that change. In the event of a dispute between the customer and Celine Zara Design over the details of the order, the details on the original order form will be taken as the final order.
Cancellation Policy for Bespoke garments
As all orders are made to Your measurements, styles and specifications or otherwise modified to Your requirements, You may only cancel Your order by agreement in writing from Celine Zara Design. All cancellations are subject to fixed charges as outlined below.
To cancel any order, You must inform us of such cancellation in writing at email@example.com and await full acceptance from Celine Zara Design. For bespoke garments, cancellation charges are based on the work and time undertaken throughout the process and are as follows:
(i) Cancellation after agreement of design: 50% of order value.
(ii) Cancellation during or after toiling process 60% of order value.
(iii) Cancellation after arrival of fabric and during cutting: 70% of order value.
(iv) Cancellation after arrival of fabric and completion of cutting: 80% of order value.
(v) Cancellation after completion: 100% of order value.
(i) We offer a bespoke design and make service. As such, You understand that the time that it will take Us to make the Goods will vary and be dependent upon such matters as the complexity of design, availability of fabric and Your ability to attend fittings. We will do our best to keep You updated with the expected date of delivery of the goods and where it is up to in the production process but unless We agree specifically in writing, time for delivery will not be of the essence.
(ii) We endeavour to complete bespoke accessories orders within 14 days from the day payment is made to the day of delivery. This is subject to change dependent on fabric availability and production capacity. Should there be a delay to Your accessories order, We will inform You as soon as possible.
Ownership of the Design and Copyright
(i) Ownership of all design material including illustrations and sketches exchanged between Us and you throughout the design process remains with Celine Zara Design. Use of this material without permission is a breach of copyright.
(ii) Ownership of all designs remains with Celine Zara Design and at no point passes to You the customer.
Risk in and Ownership of the Goods
(i) Risk in the Goods shall normally pass to You on delivery unless You have asked Us to hold onto Goods on Your behalf in which case risk passes to You at the point that You instruct Us to hold them for You. However, ownership in the Goods shall not pass to You until We have received in full, in cleared funds, all sums due to Us in respect of the Goods;
(ii) The Goods will not leave the premises of Celine Zara Design until We have received in full, in cleared funds, all sums due to Us in respect of the Goods.
Since the process that We follow, at Your instruction, is one involving Your careful consideration, development and selection of design and fabrics, We shall only accept returns for Goods which are defective. It is your responsibility to check the Goods thoroughly upon receipt. Goods returned to Us will only be accepted subject to the following:
(i) Returned Goods must be returned within the warranty period set out below;
(ii) No refund or replacement can be made against Goods which cannot be confirmed as coming from You as the person who is returning them;
(iii) Goods must be returned complete, including, where appropriate, all packaging, in an acceptable condition. We will not refund Carriage costs;
(iv) Returned Goods must be returned to Our address, stated on the accompanying invoice. We cannot be responsible for any Goods which are returned but lost in transit.
(v) If, upon inspection by Us of the returned Goods, no defects as reported by You are deemed valid, You will also be liable to pay for the cost of Carriage of Goods returned to You and this must be paid prior to their being sent.
(vi) Online, non-personalised accessories orders can be returned to us and will be refunded providing You have told Us you wish to return the item within 14 days of receiving the product . You then have up to 14 days to return the goods in an unused state as identified in section (iii)
(vii) Please note we do not accept returns on earrings due to hygiene reasons. However exceptions may be made if the earrings are unworn and we are contacted as soon as your order is received.
We warrant that the Goods are of satisfactory quality.
(i) Our liability under the warranty shall be limited to repairing or replacing the Goods in question or refunding the price of such Goods at Our discretion;
(ii) Defects discovered upon receipt of Goods delivered by Carriage - If You wish to make a claim under this warranty upon receipt of the Goods, You shall give written notice to Us within 14 days of receipt with full explanation and supporting evidence/pictures, and give Us a reasonable opportunity to inspect the Goods if we agree to their being returned to Us; (iii) Defects discovered upon use - Warranty claims can only be made within 30 days of receipt of Goods, only if a genuine defect exists and only providing the Goods are used exclusively for the purposes described at the time of order. We can give no assurance or warranty that materials used in manufacturing the Goods will be identical in colour, shade or texture to any sample You select or any swatch shown on the website.
Limitation of Liabilities
Our liability in contract, tort or otherwise arising out of the subject matter of the Contract shall not exceed the original price of the Goods. Under no circumstances will We be liable to You for any consequential, indirect or economic loss.
Data Protection and Privacy
Where We collect Your personal data, it will only be used in accordance with the Data Protection Act 1998. We shall not share it with any third party. We may use this data to contact You for any future marketing, advertising and promotional purposes. You have the right to ask Us for a copy of the information We hold on you for which We may charge a small fee, and to correct any inaccuracies. You may find links to third party websites on Our website. These websites are generally and typically subject to their own privacy policies which You should check. We do not accept any responsibility or liability for those websites.
If We are subject to circumstances outside Our reasonable control, including but not limited to war, insurrection, riot, fire, industrial disputes, civil commotion, terrorism, pandemics or act of God, We shall notify You and such notification shall have the effect of suspending Our obligations under this Contract until We notify you that the
Force Majeure event no longer applies.
If any part of these Terms is found to be void or unenforceable by any Court of competent jurisdiction, such part shall be severed from these Terms which will otherwise remain in full force and effect.
These Terms shall be governed by and interpreted solely according to English Law and the parties shall submit to the exclusive and sole jurisdiction of the English Court.
